Introduction

These Terms and Conditions ("Agreement") apply to all bookings made with Rainbow Surf Retreats ("we," "our," or "us"). By booking and participating in any of our retreats, you ("participant," "you," or "your") agree to these terms, which are legally binding. Please read them carefully before making a reservation. This Agreement is governed by the laws of Spain and is applicable to both national and international participants.

1. Nature of Services

1.1. Scope: Rainbow Surf Retreats is not a travel agency. We act as surf and travel guides, providing curated experiences through partnerships with local hotels, surf schools, and activity providers.

1.2. Third-Party Providers: Our role is limited to facilitation. Participants acknowledge that any contracts or disputes with third-party service providers (e.g., hotels, transport providers) are between you and the provider.

2. Mandatory Travel Insurance

2.1. Insurance Requirement: All participants must obtain travel insurance before attending a retreat. Insurance must cover, at a minimum:

• Surfing (including risks classified under "extreme sports").

• Ocean rescue and related medical emergencies.

• Trip cancellations.

2.2. Verification: Participants are responsible for ensuring their insurance meets these requirements. Rainbow Surf Retreats is not liable for any failure to secure adequate coverage.

3. Booking and Payment Terms

3.1. Deposits and Fees: A deposit is required to confirm your spot. The remaining balance must be paid by the deadline specified at the time of booking.

3.2. Non-Transferable: Bookings are non-transferable without prior written consent from Rainbow Surf Retreats.

3.3. Late Payments: Failure to pay the balance on time may result in cancellation of your booking without refund.

 

4. Cancellation and Refund Policy

4.1. Cancellation by Us: We reserve the right to cancel a retreat for reasons including, but not limited to:

• Force majeure (e.g., natural disasters, pandemics, or political instability).

• Insufficient participation.

• Issues with local service providers.

In such cases, you will receive a full refund of your deposit. Additional costs, such as flights, are not reimbursed.

4.2. Cancellation by You:

• Cancellations more than two weeks before the retreat: Full refund only if a replacement participant is found.

• Cancellations within two weeks of the retreat: No refund of the deposit.

4.3. Force Majeure: No compensation will be provided for cancellations or disruptions caused by events beyond our control.

5. Participant Responsibilities

5.1. Personal Conduct: Participants are expected to behave respectfully toward other participants, local communities, and service providers. Any actions that disrupt the group or violate local laws may result in expulsion from the retreat without refund.

5.2. Assumption of Risk: Surfing and ocean activities involve inherent risks. By participating, you acknowledge and accept these risks.

5.3. Liability Waiver: Rainbow Surf Retreats is not liable for injuries, accidents, or losses incurred during the retreat.

6. LGBTQ+ Safe Space

6.1. Inclusivity: Our retreats aim to create a safe and inclusive environment for LGBTQ+ individuals. While we carefully select welcoming accommodations, we cannot guarantee full acceptance in all external environments.

6.2. Cultural Respect: Participants must respect the local customs, traditions, and laws of the host country.

7. Activity-Specific Guidelines

7.1. Surfboard Transport: If you are traveling with personal surfboards, you are responsible for confirming airline policies and any associated fees.

7.2. Dietary Requirements: Participants must inform us of dietary restrictions or allergies at least 14 days before the retreat. While we strive to accommodate these needs, we cannot guarantee all requests will be met.

7.3. Rooming Preferences: Participants who snore or require special accommodations are encouraged to book single rooms to ensure the comfort of all guests.

8. Nudity and Public Displays of Affection

8.1. Nudity: Nudity is not permitted at any retreat locations or activities.

8.2. Cultural Sensitivity: Public displays of affection may be unwelcome or illegal in some destinations. Participants must adhere to local customs and laws.

9. Liability and Indemnity

9.1. Limited Liability: Rainbow Surf Retreats is not liable for:

• Personal injuries, illnesses, or deaths.

• Loss, theft, or damage to personal property.

• Delays or cancellations caused by third parties.

9.2. Indemnity: Participants agree to indemnify Rainbow Surf Retreats against any claims arising from their actions during the retreat.

10. Complaints and Dispute Resolution

10.1. Complaints: Any issues should be raised with our team during the retreat so we can address them promptly. Complaints made after the retreat may not be actionable.

10.2. Disputes: Any disputes will be governed by Spanish law and resolved in Spanish courts.

11. Privacy and Data Protection

11.1. Data Use: By booking, you consent to the use of your personal information for retreat purposes. We do not share your information with third parties except as required to facilitate your participation.

11.2. Photography and Media: We may take photos or videos during the retreat for promotional purposes. If you prefer not to appear in any media, please notify us in writing before the retreat begins.

12. Governing Law and Jurisdiction

12.1. This Agreement is governed by Spanish law.

12.2. Any legal action or proceedings will be conducted in Spanish courts.

Acceptance of Terms

By making a booking with Rainbow Surf Retreats, you confirm that you have read, understood, and agree to these Terms and Conditions.

3.2. Travel Insurance: All participants must have valid travel insurance that specifically covers surfing, ocean rescue, medical emergencies, and trip cancellations. Rainbow Surf Retreats is not responsible for participants’ failure to secure adequate coverage.
3.3. Behavioral Expectations: Participants are expected to behave respectfully toward other guests, local communities, and service providers. Disruptive or unlawful behavior may result in removal from the retreat without a refund.
4. Product Sales and Warranty 4.1. Product Information: Surfboards, apparel, and other products sold through Rainbow Surf Retreats are described to the best of our ability. However, variations in product details may occur.
4.2. Warranty and Liability: Products are sold "as is," with warranties provided only as required by applicable law. Rainbow Surf Retreats is not liable for damages, injuries, or accidents caused by the use of these products.
5. Intellectual Property and Website Use 5.1. Copyright: All content on RainbowSurfRetreats.com, including text, images, and graphics, is protected under copyright laws. Unauthorized reproduction or use is prohibited.
